ACAS have claimed that the average buying case brought against employers was costing the firm £30,000 but that this represented a ‘conservative estimate’.
The bundle of claims brought following workplace bullying are likely to include personal injury, discrimination, constructive dismissal and criminal harassment, according to ACAS, and the anxiety damages alone could amount to £5,000. The presence of any discrimination element to the claim would mean that there was no realistic monetary limit.
The current largest payout for such a claim was against Deutsche bank in 2006 and amounted to £800,000.
In an unrelated survey, The Samaritans have found an astonishing 80% of workers claim to have been bullied in the workplace and 83% of their sample said that they would rather say that they were sick with the flu rather than admit to being stressed.
