‘Personnel Today’ has canvassed senior HR figures over data which shows a 40% rise in tribunal applications and found many of them concerned that the process encouraged claims with little or no chance of success.
Anyone involved in tribunal proceedings in recent months will be more than well aware that backlogs have grown exponentially but the current figures, released in March, show a 40% increase in claims in the year to March 2008. Unfair dismissal claims, redundancy claims and claims over failure to consult have all demonstrated huge growth and leading practitioners have warned that the new ACAS code (see this month’s Legal Update) will do nothing to slow down the rate of increase.
With the worst of the shrinking in the UK job market coming in the period after that measured by these figures, we can only speculate at the current claims volume but it seems certain to be higher still.
